Sale of Property-Vendors Statement

In Victoria before a property is sold the vendor is required to provide the purchaser a section 32 vendor statement which is usually prepared on the vendor’s behalf by its Legal practitioner or Conveyancer.

A section 32 statement provides the potential purchaser particulars about the property to assist it make an informed decision about the intended purchase.

Part II, Division 2 of the Sale of Land Act 1962 sets out in detail the vendor’s obligations that must be satisfied before a contract of sale is entered into with the purchaser as follows.

Statement of matters affecting land being sold

  • A vendor under a contract for the sale of land must give to a purchaser before the purchaser signs the contract, a statement signed by the vendor that contains the matters and attaches the documents specified in this Division.

  • For the purposes of subsection (1), a vendor may sign the statement given to a purchaser under this section by electronic signature.
